Please read these Terms carefully before using or obtaining any content, product, or services through our Website.

By accessing, using, or obtaining any content, product, or services through the Website, you agree to be bound by these Terms, our Privacy Policy, and any other legal terms or policies that may be displayed on the Website (collectively “Legal Terms”).

We may change, revise, or add to these Terms at any time by updating this posting. 10. Limitation of Liability

ASEOVISION, COMPANY ASSOCIATES, AND THEIR RESPECTIVE EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS, WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A DISTRIBUTED DENIAL-OF-SERVICE ATTACK, VIRUS, OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY INFECT YOUR COMPUTER EQUIPMENT, COMPUTER PROGRAMS, DATA, OR OTHER PROPRIETARY MATERIAL DUE TO YOUR USE OR DOWNLOADING OF ANY PART OF THE WEBSITE OR ITEMS OBTAINED THROUGH THE WEBSITE, OR LINKED TO THE SITE. BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SOME OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH STATES, ASEOVISION’S AND COMPANY ASSOCIATES’ LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW, AND ASEOVISION’S AND COMPANY ASSOCIATES’ TOTAL LIABILITY IN CONNECTION WITH YOUR ACCESS TO AND USE OF THE SITE AND ANY LOSS OR DAMAGE RESULTING THEREFROM WILL NOT EXCEED [$3,000] (Dominican Republic Pesos) IN THE AGGREGATE.

You agree to defend, indemnify, and hold harmless Aseovision and Company Associates, and their respective employees, agents, officers, and directors, and their successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of the Legal Terms or your use of the Website.

 

12. Force Majeure

Aseovision will not be held liable for any delay or failure in performance due in whole or in part to any acts of nature, forces, or causes beyond its reasonable control.

 

13. Dispute Resolution

Informal Dispute Resolution

We want to address your concerns without needing a formal legal proceeding. Before filing a claim against Aseovision, you agree to try to informally resolve the dispute by contacting us as indicated in the “How to Contact Us” below. We will try to resolve the dispute informally by contacting you through email. If a dispute is not resolved informally within sixty (60) days after submission, you or we may bring a formal legal proceeding.

Limitation on Claims

Regardless of any statute or law to the contrary, any cause of action or claim arising out of or relating to the Legal Terms or the Website must be filed within one (1) year after such claim or cause of action accrues; otherwise, such cause of action or claim is permanently barred.

 

14. Miscellaneous Terms

Governing Law

All matters relating to the Website or Legal Terms will be governed by and construed in accordance with the laws of the Dominican Republic without regard to its conflict of law principles.

Entire Agreement

The Legal Terms constitute the sole and entire agreement between you and Aseovision with respect to the Website and any item purchased through the Website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Website. Any ambiguities in the interpretation of the Legal Terms will not be construed against the drafting party.

Waiver

If any provision of the Legal Terms is determined to be unlawful, invalid, or unenforceable, such provision will be deemed amended to achieve an economic effect that is as near as possible to that provided by the original provision, and enforced to the fullest extent permitted by applicable law. Such determination will not affect the validity and enforceability of any other remaining provisions.

Responding to Legal Process

We may respond to and comply with any subpoena, warrant, or other legal order issued by a court having jurisdiction over us (“Legal Process”) that we believe to be valid. Aseovision is not responsible for any direct or indirect losses that you may incur as a result of our complying with the Legal Process.

17. Reservations

Reservation Fees

Aseovision requires clients to pay 100% of the total reservation cost, including any one-time costs and applicable taxes, upfront to secure their booking. 

Booking Start Date

Clients are not allowed to select a start date for their reservation that falls within the next 5 days. If custom poster designs are needed, the client should not be allowed to select a start date that is within the next 28 days. This restriction is in place to ensure adequate time for processing, preparation, and design.

 

18. Custom Poster Designs

Fees and Payment

Aseovision charges an additional fee for custom poster designs, in addition to the booking costs. Once a client accepts a price quote for custom poster design, they will receive a separate invoice for this service. Payment for custom poster design must be made upfront from the client’s Aseovision account on the Website.

Payment Delay

If a client takes longer than 7-10 days to accept a price quote and submit payment for custom poster design, it may result in a delay in the creation of the poster designs. In such a situation, the reservation start date and/or end date will not be postponed due to the client’s late payment.

 

19. Image Upload

Clients are required to upload the images they want displayed on each poster within the selected lightboxes. Image uploads must be in JPG format. Clients must also specify the order or sequence in which they want their images to appear on the rotating lightbox.

 

20. Taxes

All fees and charges listed on the Website are exclusive of applicable taxes. Aseovision will collect and remit any taxes required by Dominican Republic law.

 

21. Refunds and Cancellations

Reservations

Once payment has been submitted for a reservation, this service can no longer be canceled or refunded.

Custom Poster Designs

Once payment has been submitted for custom poster design, this service can no longer be canceled or refunded.

 

22. Late Payment

Reservations

If payment for a reservation is not received within 15 days after the due date, the service with overdue payment will be canceled, and no refunds will be provided.

Custom Poster Designs

Any delay in payment for custom poster design will result in a delay in the creation of the poster designs. In such a situation, the reservation start date and/or end date will not be postponed due to the customer’s late payment.

 

23. Client Accounts Page

Clients must create an account on the Website with an email and password to access certain features, including saving shopping carts, reviewing previous orders and receipts, viewing upcoming invoices and payment dates, and accessing a map or list showing the locations they have currently reserved or rented. Multi-factor authentication is required for account security.

Clients are required to create an account before submitting any purchase or payment on the Website.
